1. Consent to Receive Messages
By providing your mobile phone number and opting in to SMS communications from Pure NADH Research LLC ("we," "us," or "our") whether during checkout, through a subscription form, via a website pop-up, or by texting a keyword to our designated number, you expressly consent to receive recurring automated text messages from PureNADH. These messages may include, but are not limited to: order confirmations and shipping updates; abandoned cart reminders; promotional offers, discounts, and product announcements; requests for product reviews or feedback; and transactional messages related to your account or subscription.
Message frequency varies depending on your interactions with us and the types of messages you have opted in to receive. Consent to receive SMS messages is not a condition of purchasing any product or service from PureNADH.
2. Message and Data Rates
We do not charge a fee for our SMS messaging service. However, standard message and data rates imposed by your wireless carrier may apply. You are solely responsible for any charges assessed by your mobile service provider in connection with receiving text messages from us. 3. How to Opt Out
You may opt out of receiving SMS messages from us at any time by replying STOP to any text message you receive from PureNADH. Upon receiving your opt-out request, we will send a single confirmation message to confirm that you have been unsubscribed, and you will no longer receive marketing text messages from us unless you re-subscribe at a later date.
Please note that replying STOP is the designated method for opting out of our SMS program. Alternative words, phrases, or requests sent via other channels (such as email) will not be processed as a valid opt-out from SMS messaging. Transactional messages directly related to an existing order (such as shipping notifications) may still be sent after you opt out of marketing messages, as permitted by law.

5. Changes to Phone Numbers and Short Codes
We reserve the right to modify, change, or discontinue any telephone number or short code used to operate our SMS messaging service at any time. If we make such a change, we will make reasonable efforts to notify you. You acknowledge that any messages you send to a telephone number or short code that we have changed, including STOP or HELP requests, may not be received, and we will not be liable for failing to honor requests sent to a number that is no longer active.
6. Service Limitations
To the extent permitted by applicable law, Pure NADH Research LLC shall not be liable for any failed, delayed, or misdirected delivery of any SMS message sent through our messaging service, any errors contained in such messages, or any action you may or may not take based on the content of a message. SMS delivery is dependent on your wireless carrier's network and coverage, and we cannot guarantee delivery to all devices or in all locations.
7. Your Privacy
Your privacy is important to us. We will not sell, rent, or share your mobile phone number with third parties for their own marketing purposes. Your phone number and related information will be used solely to deliver the messages described in these terms and to support our customer service operations. 8. Arbitration and Class Action Waiver
a. Agreement to Arbitrate
By opting in to our SMS messaging program or by purchasing any product or service from PureNADH, you agree that any dispute, claim, or controversy arising out of or relating to these SMS Messaging Terms and Conditions, your receipt of text messages from us, or any related matter (each a "Claim") shall be resolved exclusively through binding individual arbitration, rather than in court. Arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its applicable rules and procedures.
Arbitration is a private dispute resolution process in which the parties submit their disagreement to a neutral arbitrator who issues a binding decision. The arbitrator is required to issue a reasoned, written award that includes findings of fact and conclusions of law. The arbitrator's decision is final and enforceable in any court of competent jurisdiction. Each party shall bear its own attorneys' fees, expert costs, and other expenses incurred in connection with the arbitration, unless the arbitrator determines otherwise.
b. Arbitration Procedures
All Claims shall be heard by a single arbitrator. Arbitration proceedings shall take place in the State of New Jersey, or at such other location as mutually agreed by the parties. The parties may choose to participate in person, by telephone, by video conference, or through written submissions. The arbitration shall be governed by the Federal Arbitration Act (FAA). If the arbitrator determines that the FAA does not apply, the laws of the State of New Jersey governing arbitration agreements shall control. Any threshold disputes regarding the enforceability, applicability, or validity of this arbitration provision shall be determined exclusively by the arbitrator.
c. Right to Opt Out of Arbitration
You may opt out of this arbitration agreement within thirty (30) days of the date you first purchase a product from PureNADH or first opt in to our SMS messaging program, whichever occurs first. To opt out, you must send a written notice to the following address:

Your written notice must include your full name, mailing address, and a clear statement that you do not wish to resolve disputes through arbitration. Opting out of arbitration will have no effect on your ability to use our products, services, or SMS messaging program. Any opt-out request received after the thirty-day deadline will not be valid, and you will be required to resolve any Claims through arbitration as described above.
d. Class Action Waiver
You and Pure NADH Research LLC agree that any Claims shall be brought solely in your or our individual capacity, and not as a plaintiff or class member in any purported class action, collective action, consolidated proceeding, or representative proceeding. Unless both parties agree otherwise in writing, the arbitrator may not consolidate Claims of multiple parties, join additional parties, or preside over any form of class or representative proceeding. If any court or arbitrator determines that this class action waiver is unenforceable for any reason, the arbitration agreement in its entirety shall be deemed void, and the Claim shall proceed in a court of competent jurisdiction.
9. Governing Law
These SMS Messaging Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles, except to the extent preempted by the Federal Arbitration Act or other applicable federal law.
